Regulation 5 of PUWER 1998 obliges you to keep it maintained in an efficient state and in good repair, and Regulation 6 obliges you to have it inspected at suitable intervals by someone competent to do so. The HSE sets out what that means in practice in HSG76 (Warehousing and Storage): a formal expert inspection by a SARI accredited inspector at least annually. Where a business cannot produce those records, HSE enforcement can escalate to prosecution and unlimited fines.

The SEMA Red, Amber and Green System

• Amber — the component is damaged. The bay must be off-loaded or its safe working load reduced until repaired within four weeks.
