Pallet racking is classed as work equipment under the Provision and Use of Work Equipment Regulations 1998 (PUWER). Every employer in Wales who operates pallet racking has a legal duty to ensure it is maintained in a safe condition and inspected by a competent person at appropriate intervals. The HSE guidance document HSG76 — Warehousing and Storage — specifies that pallet racking must be inspected by a SARI accredited inspector at least once every 12 months. Failure to comply with PUWER 1998 can result in prosecution, unlimited fines and, in the most serious cases, imprisonment.
